Tripura High Court: Takes Suo Moto Case Of Death Of Woman By Suicide

The video of a woman in a compromising position with a man was leaked and displayed in the public before the members of her village who gathered to discuss the issue. She was subjected to humiliation by the leak of the video but the actions of the villagers of insulting her and extremely humiliating her, led her to commit suicide.

The Court heard of the incident and took suo moto cognizance of the case and ordered probe into the incident and asked the Superintendent of Police to supervise the probe. The circulation of the video on any online platform was to be blocked with immediate effect. The Court considered the actions of the villagers as a violation of the human rights and barbaric in nature.

Order Framing Charges Or Refusing Discharge, Not Affected By Bar Under Section 397 (2) Cr.P.C.

The charges framed by the Trial Court are subject to revision as the framing of charges or refusing discharge is neither an interlocutory order nor a final order and would not be affected by the bar under Section 397 (2) of the Code of Criminal Procedure. This judgement came from the case of Sanjay Kumar Rai v. State of Uttar Pradesh where the decision of the Allahabad High Court was challenged before the Supreme Court. The Court has referred to various cases including the Madhu Limaye case for clarifying the correct position of law.

West Bengal Urges Uniform Price Fixation For COVID Vaccines

The Supreme Court has taken up a suo moto case regarding the distribution of the essential supplies during COVID. The State of West Bengal had filed an affidavit requesting the Supreme Court to direct the Central government to cap the prices of the vaccines at a uniform fixed rate by setting aside the differential pricing in the various states. 

The State government also suggested seeking advice from the National Pharmaceutical Pricing Authority on the vaccine policies and the pricing of the vaccines. The pricing system was challenged on the basis of it being arbitrary and discriminatory and not based on any intelligible differentia. It is important for the government to ensure universal coverage of the vaccination considering the desperate situation of the country.

A Public Interest Litigation was filed by advocates before the High Court regarding the violence after the Assembly Elections in the State in which numerous people were subjected to assault. The life and liberty of the people of West Bengal is at stake and it is important to prevent and control the violence.

The houses of the opposition party supporters were vandalised and the supporters were physically assaulted and their properties were looted by the activists of the ruling party. The High Court has called for the report of the law and order situation in the State from the government after the suit was instituted.

The laws in Germany recognise only the biological mother of the child to be legally recognised as a parent and the female partner has to go through a formal adoption procedure to become the child’s second parent even if they are legally married. The second woman has to apply for adoption of her own child. Imagine if that happened in India with the fathers of the children!

She had to struggle a lot with the hospital formalities when she took her son for treatment when her partner went to work as she was not legally recognised as a parent. The case has been referred to the constitutional court as it is not the plea of one but all the other rainbow families.
