Allahabad HC directs UP to ensure adequate release of water in Ganga

The Allahabad High Court has directed the Uttar Pradesh government to ensure the release of excess 250 cusecs of water upto 3700 cusecs in river Ganga before 15 days of the bathing days in Magh Mela, so that sufficient quantity of water can be maintained. This order was passed by a division bench consisting of Justices Ashok Bhusan and Arun Tandon on a writ petition filed by Hari Chaitanya Brahmchari of Allahabad. The Court has also directed the state government to obtain instruction and submit proposal to check the flooring of such dirty water generated during the Magh Mela itself by means of affidavit on the next date. The judges have also directed the Ministry of Water Resources, New Delhi to submit the details of water level of the Ganga at different planes in Allahabad by means of a comparative charge of the year and earlier two years. The Court has also directed the Kanpur Nagar Nigam administration to ensure and take appropriate steps in collaboration with UP Pollution Control Board so that no untreated water is discharged in the Ganga from the tanneries and other industries situated near the banks of river Ganga. The Court directed the Central government to consider the functioning of STP in Allahabad as per the project submitted by the state government. The Court observed, ‘Right to have clean water is a fundamental right under article 21 of the Constitution’. UNI
