The Allahabad High Court recently observed that "inability of the police authorities to provide timely directions to the Govt Advocate/ Additional Govt Advocate in bail applications causes delay in the hearing of the bail applications, and often leads to irrational incarceration of an accused in jail."
A Single bench of justice Ajay Bhanot has thus asked the Director General of Police, Uttar Pradesh, to create a fair, clear, and unequivocal system for directing the GA/AGA in bail petitions before the High Court.
It has been directed that the method be created within 8 weeks and contain the designation of the officials, the responsibilities or tasks that they must do, and a specified time limit for such purpose.
The statements were made in response to the Police officials' refusal to provide directions to an AGA on one Sahil's bail plea.
As a result, the AGA was unable to submit the entire and truthful facts before the Court, and the bail motion was unable to be heard.
"The most secure foundation of the rule of law and the reliability of constitutional order belongs not only in the existence of an independent judiciary, but also in the concern given by every constitutional unit of government to the fundamental rights of all individuals, as well as the activities of state personnel to strictly comply with Court rulings."the Court said before departing.
