Pre-Requisites Of Live-In Relationship

  • In “D. Velusamy vs. D. Patchaiammal (2010), Supreme Court held that the couple must present themselves to society as spouses and be of legal marriage age or competent to enter into a legal marriage, even if they are single.

Court’s Order

  • The court stated that the live-in relationship between a married man and an unmarried woman is not permissible.
  • The petitioners' case was dismissed by Justice Vivek Puri, who directed the Senior Superintendent of Police, Faridkot, to investigate the grievances of the petitioners as outlined in their representation.
  • The High Court has reaffirmed that personal life and liberty are guaranteed under Art. 21 regardless of whether a relationship between two individuals is immoral or unsocial.
  • It was also observed that under section 26 of the Rajasthan Police Act, every police officer must protect the life and liberty of the citizens.
