Madras HC Grants Conditional Bail To Former AIADMK Minister M. Manikandan In Rape Case

The former AIADMK Minister, M Manikandan had been charged with the offence of rape on the false pretext of marriage. He has been in judicial custody since June 26, 2021. The Madras High Court has granted bail to the accused. The bail was granted by Justice M Nirmal Kumar, stating that there was a clear difference between rape and consensual sex. The case is of Dr M Manikandan V. State.

Supreme Court adjourns plea against service tax levy on Haj pilgrims via HGOs

The Supreme Court Bench consisting of Justice A M Khanwilkar and Justice Sanjiv Khanna heard a plea filed by the All India Haj Umrah Tour Organiser Association, based in Mumbai for the issuance of directions to the Centre to not levy service tax on Hajis who operate through Haj Group Operators (HGO) and not levy taxes on the performance of Haj as it was a religious activity. It was contended that the levying of service tax on people who practiced Haj was unconstitutional and violative of the Fundamental Rights enshrined in Article 14, 19, 21 and 25.

Delhi High Court extends interim protection from coercive action for Newsclick founder Prabir Purkayastha in corruption case

The case was of Prabir Purkayastha V. State of NCT of Delhi. Criminal cases related to foreign funding and over-evaluation of shares were registered against Newsclick founder, Prabir Purkayastha. The Delhi High Court extended to Purkayastha interim protection against coercive action and arrest. The decision was given by the Single judge Bench of Justice Yogesh Khanna. Prabir Purkayastha had filed a plea seeking anticipatory bail.

SC Will Hear Appeals Against Gujarat HC Judgement Striking Down 97th Amendment 

The Division Bench of Gujarat High Court consisting of Justice Bhaskar Bhattacharya and Justice J B Pardiwala had passed a judgement on a PIL which sought that the 97th Amendment to the Constitution which introduced Part IX B be declared as ultra vires to the Constitution of India. It was contended that the amendment was quashed without taking any recourse to Article 368 (2) of the Constitution. The 3 judge Bench comprising Justice  R F Nariman, Justice K M Joseph and Justice B R Gavai would hear the matter.

Supreme Court Bar Association urges CJI NV Ramana to consider resuming physical hearing in Supreme Court

The Supreme Court Bar Association has written to the Chief Justice of India, N V Ramana, requesting that physical functioning of the Supreme Court be resumed given that COVID cases are decreasing in number. The SCBA, through its President, Senior Advocate Vikas, pleaded that physical functioning of the court takes place while adhering to COVID protocols. The SCBA also stated that to avoid overcrowding, the media would remain outside the premises and watch the proceedings virtually through video conferencing.
