SC: High Courts Should Not Pass Oral Directions To Restrain Arrest

The Supreme Court observed that the procedure of 'oral direction' to not arrest an accused is irregular. The decision was given by a bench comprising of Justice D Y Chandrachud and Justice M R Shah. The court observed that the text of a written order is what is binding and enforceable and such oral directions can cause serious misgivings. The case was of Salimbhai Hamidbhai Menon v. Niteshkumar Maganbhai Patel.

Permitting Public Entity To Not Dispose Of RTI Application In Timely Manner Would Defeat The Purpose Of Right To Information Act

The Delhi High Court has held that permitting a public entity, Bureau of Pharma Public Sector Undertakings of India (BPPI) in the present case, to not dispose of an RTI application in a time bound manner would defeat the purpose of the Right to Information Act, 2005. The decision was given by Justice Rekha Palli. The case was of Cradle Life Sciences Pvt Ltd v. UOI & Anr.

Karnataka HC Allows Maternity Leave To Senior Resident Doctor Employed On Contractual Basis

The order passed by the Joint Director, ESIC Medical College and Hospital, Kalaburagi, denying maternity leave to a doctor employed with it on contract basis was quashed by the Karnataka High Court. The decision was given by Justice Nataraj Rangaswamy. The case was of Dr. Swetha v. Union of India. The writ petition was allowed and the petitioner was granted leave.

Kerala High Court Says Criminal Antecedents Of Donor Irrelevant For Organ Donation

TheKerala High Courthas held that the criminal antecedents of a donor are not to be considered by the authorization committee for transplant of human organs. The decision was given by Justice P.V. Kunhikrishnan. There is no such thing as a criminal kidney. The case was of Radhakrishna Pillai v. District Level Authorization Committee for Transplantation of Human Organs.

A Bench comprisingJustice AM Khanwilkar, Justice Sanjiv Khanna and Justice JK Maheshwariwere to hear the appeals.

The Supreme Court has remarked that illegal construction has to be dealt with strictly to ensure compliance with the rule of law. It directed the demolition of the twin 40 storey towers in the Emerald Court project of Supertech Ltd in NOIDA for violation of building norms.
