Magistrates Cannot Extend Time To Complete Investigation In UAPA Cases

The case was of Sadique v. State of Madhya Pradesh. The decision was given by Justices Uday Umesh Lalit, S. Ravindra Bhat and Belam M Trivedi. SC: Government Should Keep Taxation System Convenient And Simple

The case was of South Indian Bank Ltd. v. Commissioner of Income Tax. The decision was given by Justices Sanjay Kishan Kaul and Hrishikesh Roy. The court opined that it was the responsibility of the government to ensure that the taxation regime is convenient and simple. Unnecessary litigation can be avoided without compromising on generation of revenue, it held.

Salve appeared for the appellant whereas Sr. Advocate PS Narasimha and Sr. Advocate Parag Tripathi appeared for the respondents. It was held that every error of law committed by the Arbitral Tribunal would not fall within the expression 'patent illegality'.

High Courts Can Exercise Limited Factual Review Under Section 103 CPC

The case was of K.N. Nagarajappa v. H. Narasimha Reddy. The decision was given by Justices L. Nageswara Rao and S. Ravindra Bhat. Section 103 deals with the power of High Court to determine issues of fact. The Supreme Court observed that High Courts are empowered to exercise limited factual review under Section 103 of the Code of Civil Procedure.

The case was of Safai Karamchari Andolan and Others v. Union of India and Others. In this case, the State was ordered to issue critical guidelines in this regard before the next date of hearing. The matter is set to be heard next on November 10, 2021. The decision was given by a Bench comprising Chief Justice Sanjib Banerjee and Justice PD Audikesavalu.
