UPA TELLS SC: NO BAR ON SONIA GANDHI BECOMING PM

The Union Government in its affidavit filed in the Supreme Court asserted that there was no bar under the Constitution of India against Congress president Sonia Gandhi becoming the Prime Minister of the country.

According to UPA government affidavit, Foreign origin of an alien citizen of the country does not debar him/her from holding a constitutional post such as the President of India or the Prime Minister of the country.

The affidavit is : ‘The Constitution of India, like the constitution of other countries, does not differentiate between an alien citizen and a natural citizen of the country since there is only a single citizenship in India.’ The Union Government has filed this affidavit in response to a petition filed by the Rashtriya Mukti Morcha (RMM) raising the issue whether a person of a foreign origin can hold a constitutional post in India like that of the President and the Prime Minister.

The case was listed for hearing on Wednesday that is on December 17 but was adjourned. The RMM has filed an appeal in the Supreme Court against the Delhi High Court judgement vide which its petition was dismissed.

It may be noted that Ms Gandhi had to withdraw her claim to form a government at the Centre when the then President A P J Abdul Kalam raised some legal objection on her becoming the Prime Minister.
