MADRAS HC SETS ASIDE ORDER OF ACP 12/23/2008 Madras High Court set-aside an order of the City Police Commissioner denying permission to Viduthalai Chiruthaigal Kattchi (VCK) to hold a meeting. While disposing off the petition filed by Era Selvam, Central Chennai District Secretary of the Youth wing of the VCK, Justice K Suguna, remitted the matter back to the Assistant Commissioner of Police (ACP), Anna Nagar. The Judge said, the ACP should dispose of on or before December 23, the application filed by the petitioner on December 10 following the procedure under Section 14(4) of city police Act. She also directed the petitioner to file an affidavit that no speech would be made with regard to the banned LTTE before the ACP. In his petition, Mr Selvam submitted that he had sought permission to hold a meeting, ‘Ilanchiruthaigal Ezhuchi Pasarai’ to declare the inauguration of the Youth Wing of the Party. The meeting was to be held on December 26 at Pulla Avene, Aminjikarai, here. But, on December 20, police denied permission through a letter citing reasons like congestion, heavy vehicular movement on account of Christmas Day, New Year and Pongal festivals and interest of people. The impugned Order also stated that there was no space to park the vehicles and police apprehended that statements would be made in the meeting supporting the banned organization, the petitioner added. The petitioner also sought the court to interfere in the matter and direct the police to grant him permission to hold public meeting. UNI
