Judge R Basant Will Monitor Sister Abhaya Case Investigation 1/9/2009 The Single Bench Judge Justice R Basant of the Kerala High Court made it clear that it was his bench which should monitor the progress of the investigation into the Sister Abhaya murder case. The court observed in an order that monitoring of the investigation shall be by this bench to which single bench criminal matters were assigned. The court also made clear in the order that this will be subject to the supervision and monitoring of the investigation by the Chief Judicial Magistrate Court, Ernakulam. The court also stated that the CBI investigating officer was obliged to proceed with the investigation with determination. The CBI, DIG, Chennai and Joint Director of South must supervise the investigation, as they are expected, under the order dated October 24, 2008. It also directed to report this fact to the bail bench of Justice K Hema. In its observations, the court said the bail bench cannot and did not takeover the burden of the monitoring of the investigation. The question before the bench was whether bail should be granted to the three accused --Father Thomas Kottur, Father Jose Puthrukkayil and Sister Sephi. The three accused were granted bail recently. The High Court made this order while disposing of a petition filed by the CBI, seeking to clarify whether they have to continue with the investigation or not. UNI
