Domicile Determined By Marriage

In a significant ruling, a division bench of the Rajasthan High Court has held that a woman on her marriage, whatever her domicile of her origin might have been, acquired 'domicile' of her 'husband.' Domicile determined by marriage : Consequently, the division bench 'dismissed' a special appeal petition moved by the state government challenging a single bench judge verdict, which had also taken a similar view, rejecting the Government plea contrary to this. The state Government, in 1988, had pleaded before the single judge that the petitioner Asha Devi originally belonging to Haryana, after her marriage, was merely residing with her husband in Rajasthan. The Government had contended that she couldn't be termed as 'domicile' of this state and hence cannot be permitted to attend an interview for a training course to qualify as a woman health worker.
