SC To Check Damage Of Properties During Agitations 1/17/2009 The Supreme Court directed the Centre and all states to respond by February 20 to the suggestion of the court why the organiser of an agitation, strike or bandh should not be held responsible for the damage and destruction of public and private properties in such agitations. A bench comprising Justices Arijit Pasayat and Asok Kumar Ganguly fixed March 17 and 18 for the next hearing of the case. The suggestion of the court came during the hearing of the case relating to damage and destruction of public and private properties in the Gujjar agitation last year in support of their demand for SC status to their community in Rajasthan. Justice Pasayat asked, ‘Why should a political party or any other organisation calling for an agitation, road blockade, strike and bandh not be held responsible for paying compensation and damages for the public and private properties destroyed in such agitation?’ The apex court had taken suo motu cognizance of the violence caused in the Gujjar agitation and appointed a committee, headed by Justice K T Thomas, on June 18, 2007 for submitting its report for preventing destruction to public and private properties in such agitations. The committee has submitted its report in this regard. The apex court had also taken serious note of harassment and hardships caused to the public at large during such agitations. It indicated that top leaders, who give calls for the agitation and road blockade, should also be prosecuted for the destruction of property and harassment caused to the common man. UNI
