Lawyers Protest Against CrPC Amendment 19 Jan 2009, 2019 hrs IST, TNN ALLAHABAD: Up in arms against the proposed amendments in Section 309 of CrPC, lawyers here abstained from judicial work on Monday and set afire copies of the amendment outside the HC premises. High Court lawyers entered the premises without their bands and lodged their protest against the Centre's move. Terming the amendment as ridiculous, joint secretary (administration) HCBA, JB Singh observed that it was a grave folly on part of the government, which did not even deem it fit to consult lawyers and jurists country-wide before arriving at an impractical decision. The lawyers unanimously resolved to continue their protest in a democratic manner till the government agreed to withdraw the amendment. President of Central Administrative Tribunal (CAT) Bar Association Allahabad, KP Singh while addressing a meeting of lawyers pointed out that it had been an established practice over the years that lawyers unable to appear in a particular case, sought a future date for hearing by filing an application. The government move to usurp the right of lawyers would not only hamper judicial proceedings but also harm the interest of litigants, the members pointed out. Secretary of the CAT bar association, Pankaj Srivastava while decrying the government move called upon the fraternity members to oppose the decision tooth and nail and support the protest being mounted by the UP Bar Council. Meanwhile, HC lawyer Sati Ram Yadav, national president of All India Democratic Lawyers' Association, while voicing concern over the move, informed that amendments in Sections 41, 309 and 320 were against the interest of litigants as well as lawyers. He held the government as well as the opposition responsible for the turmoil and pointed out that when the proposal had been tabled in the house, the opposition should have raised resistance. Lalji Yadav, president of Samajwadi Party city lawyers' cell too has opposed the amendment and demanded its withdrawal.
