IIT Faculty Approaches HC For Enhancement Of Retirement Age 1/19/2009 The IIT faculty has approached the Delhi High Court to direct the Government to enhance the superannuation age of its Scientific and Engineering faculty from 62 years to 65 years as is applicable to teachers in the similar institutes. Arguing before Justice Kailash Gambhir, lawyers for the IIT professors said the Government had initially in March 2007 enhanced the superannuation age of the faculty but later on it withdrew its order in 2008, thereby many professors were retired with effect from the back date. About 25 Scientific and Engineering professors have filed their petitions stating, ‘we all are professors, Scientists teaching highly qualified students. There is already a shortage of qualified staff who can teach the students of higher education and above it the Government’s decision to withdraw its orders has caused shortage of experienced staff further.’ The petitioners, senior professors with an experience of almost 30 years each, including Mr Suresh Kumar Sud, Mr Lalit Kumar Das, Mr Gaj Raj Yadav and Ms Kaasturi Gadgil have urged the court to quash the Ministry of Human Resource Development (MHRD) order of March 28, 2008 that says that enhancement of retirement age cannot be extended to assistant professor, associate professor and professors. Lawyers for the faculty, Mr Prem Kumar and Mr A S Chandiok, argued that the Government should be directed to restore its earlier order of March 30, 2007 which said the Design and Scientific faculty were fully engaged in teaching at par with other faculty engaged in teaching and were appointed against regular sanctioned teaching positions. Justice Gambhir transferred the matter to Justice Siddharth Mridul as he was hearing the matter earlier. The matter will now be heard on January 23. UNI
