SC Issued Notices To Health Minister, Mah. Govt. On Not Allowing Abortion In Deformity 2/14/2009 The Supreme Court issued notices to the Union Health Ministry and the state of Maharashtra on a petition challenging the Bombay High Court judgement not allowing a woman to get her child aborted due to deformity in the child in the fetus. A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam issued the notices on the petition filed by a gynecologist, Dr Nikhil Dattar, praying that abortion should be permitted even after 20th week of pregnancy in case of deformity in the baby womb or in heart in the fetus. Senior counsel Colin Gonsalves, appearing for the petitioner, contended that in other countries medical termination of pregnancy was permitted even upto 40th week of pregnancy and in India also in certain circumstances abortion should be permitted even after 20th week of pregnancy. Under the Medical Termination of Pregnancy Act 1971, abortion after 20th week is permitted only when there is a threat or a danger to the life of a pregnant woman. UNI
