SC declines to stay mafia don Babloo Srivastava conviction New Delhi | Wednesday, Mar 4 2009 IST The Supreme Court today declined to stay the conviction of mafia don Om Prakash Srivastava, alias Babloo Srivastava, who wanted to contest the Lok Sabha elections from Uttar Pradesh. Chamber Judge Justice Altmas Kabir dismissed the petition of Babloo, who is serving life imprisonment for murdering Additional Customs collector L D Arora in March 1993. Babloo, who is presently lodged in Naini Jail, Allahabad is facing a number of criminal cases. He was sentenced to life imprisonment on September 30 last year. Justice Kabir, while dismissing his petition for stay of the conviction, took note of the conduct of the petitioner who remained absconding for a long time. The judge, however, directed that the appeal of the petitioner shall be disposed off expeditiously by the apex court. As per the provisions of Representation of the People Act, a person who has been awarded a sentence of more then two years cannot contest elections unless and until his conviction is stayed by the appellate court. Bollywood actor Sanjay Dutt will also have to get Supreme Court's nod before he contests Lok Sabha elections from Lucknow as Samajwadi Party candidate as he has been sentenced to six years' imprisonment by TADA court Mumbai and the appeal is pending in the apex court. Others in a similar situation are MPs Pappu Yadav, Syed Sahabuddin, former MP Anand Mohan Singh and his wife. -- (UNI) -- 04DI42.xml
