Remove disgruntlement in youth to check violence in courts

Chief Justice K G Balakrishnan sought the legal fraternity to ensure equitable distribution of work to prevent flare ups like the one occurred in Chennai recently. ‘Violence occurred in Chennai because young lawyers are disgruntled due to lack of equitable distribution of work. The problem can be solved if the very legal profession, not the government, takes care of the youth,’ he observed while inaugurating silver jubilee celebrations of ‘High Court of Bombay at Goa’. He regretted that the violence occurred in Chennai, where more than 7,000 bar members existed and the system was capable of remedying the situation. Justice Balakrishnan also renewed his plea with the Centre for investing in ‘judicial infrastructure’ besides raising the number of judges and courts for reducing the pendency of cases. ‘All over the world, the judges strength is high but not in India, the Centre has been asked to invest in judiciary infrastructure and appoint more number of judges,’ he said. Imparting adequate training for the young lawyers besides public prosecutors through judicial academies would also help reduce pendency, he said. The justice was critical of the government’s appointing prosecutors for three or four year term or changing them sometimes with the change of governments. ‘The prosecution system is not complete without adequate understanding of the criminal justice system and this calls for training of the young lawyers,’ Justice Balakrishnan said. Better legal education makes better lawyers and in turn best judges, who are capable of disposing of the cases fast with ease. At the same time, the supporting police and criminal justice system including the forensic science laboratories should also be competitive. The criminal cases keep on pending in courts for want of forensic reports which take years together, he pointed out. Besides, developing on alternative mechanisms of justice delivery like the Mediation Centres, Lok Adalats and evening courts, the efficiency of the existing judges, particularly in the court management also needs improvement, the Chief Justice said.
