3/26/2009 The Kerala High Court closed the suo motu contempt proceedings initiated against Malayalam daily Kerala Kaumudi. The contempt proceedings were initiated on the basis of an editorial published by the daily on December 18 last year having imputations against a Single Bench Judge and the then acting Chief Justice of the High Court. A Division Bench comprising Mr Justice K Balakrishnan Nair and Mr Justice M L Francis George dropped the proceedings stating that though the editorial concerned tends to interfere in the course of justice, it was clear it was not intentional. Though the contemners had not admitted the contempt, on notice they had appeared and owned the editorial. They had also filed an unconditional apology and thus it was not necessary to proceed with the contempt proceedings against the daily, the court observed.
