Orissa High Court allowed prayer of the nun, who was allegedly raped during the communal violence in Kandhmal in August last, to hold the Test Identification (TI) parade in the Chowdwar Circle Jail near here.
Adjudicating the petition of the nun praying for shifting the venue of the TI parade outside Kandhamal, single judge bench of High court Mr Justice B K Patel passed the order.
Earlier on May 7 last, Baliguda Sub-Divisional Judicial Magistrate Dola Gobinda Barik had fixed May one for conducting the TI parade of one of the prime accused in the rape case inside the jail.
But the nun instead of turning up for the TI parade moved a petition before the judge to praying for shifting the TI parade outside Kandhamal for security reason.
The SDJM, however, rejected the petition and fixed May seven to conduct the TI parade inside the Baliguda sub jail.
The nun's counsel Manas Ranjan Singh moved a petition before the SDJM on May 7 last praying for adjournment of the TI parade for three weeks on the ground that his client had moved Orissa High Court for shifting the venue of the TI parade.
In her petition before the High court, the nun had stated that the TI parade be conducted inside the Choudwar Circle jail as was held earlier on the direction of a division bench of the court.
The Baliguda SDJM, however, granted 12 days' time and fixed May 19 for conducting the TI parade inside the Baliguda sub jail.
The nun had identified two of ten accused presented before her during the first TI parade conducted under the supervision of the Cuttack Sadar Sub Divisional Judicial Magistrate(SDJM) inside the Choudwar central jail premises on January five last.
The first TI parade was conducted as per the direction of the Orissa High court which allowed a petition of the nun to conduct it outside Kandhmal.
