The Allahabad High Court issued notices to the Uttar Pradesh Bar Council, Allahabad, Bar Council of India, New Delhi and the state government to show cause as to why the resolution passed by the Bar council of UP, asking the lawyers of the state to abstain from judicial work be not set aside.
A Bench of Justices S Ambuwani and R V Singh also directed the state government to take appropriate action in the matters, which have resulted into the resolution passed by UP Bar Council.
Since the strike by the lawyers has seriously affected the work of our Court, overwhelmed with urgent fresh, unlisted or listed cases, therefore, we have taken suo motou action in the matter and directed the registry to register the matter and place it before the Chief Justice to nominate appropriate Bench to hear the matter", the Bench remarked.
The Court passed this order taking serious note of the call given by UP Bar Council, asking the lawyers of all the 71 districts of the state to abstain from judicial work today.
The UP Bar Council had passed a resolution asking the Bar Association to abstain from judicial work protesting the inaction of the state government over the incidence of lathi-charge on lawyers at Gonda a week ago and similar incidents at Kanpur, Allahabad and Firozabad.
The Court was under the constitutional duty to maintain law and order. If a section of society is aggrieved against the administration, which results in a call for strike, the state government must take appropriate measures to conduct an enquiry to take appropriate action, the Bench observed.
