he Nagaland Government has issued a fresh memorandum on the implementation of the Nagaland Retirement from Public Employment (Second Amendment) Act, 2009, as there was no stay order from the Supreme Court on the implementation of the Act.
Official sources here today said the memorandum issued by Chief Secretary Lalthara said the apex court had allowed the State government to take follow up action necessary to implement the Retirement Act, including making fresh appointments and posting of new incumbents against the retirement vacancies.
However, these would ultimately be subject to the final judgement and order that may be passed by the Supreme Court. The memorandum further clarified and reiterated that those people affected by the Retirement Act would cease to be Government employees with effect from October 31, 2009, and that all the arrangements listed in the office memorandum dated October 30, 2009, to ensure smooth transaction of Government business would continue to be in place.
