The Delhi High Court today issued a notice to the MCD to reply by September 2 on the contradictory stand taken by it on the issue of relocation of industrial units outside the state. A petition was filed by a factory owner seeking relocation of his unit outside Delhi as the MCD had cancelled his licence to run it. The Punjab Motor Workshop, situated at Nicolson Street in North Delhi, had sought the Court's intervention to get an alternative plot from the DDA outside Delhi as the MCD cancelled its licence stating that it came under heavy industry category and could not operate from the non-performing area. DDA's Counsel Sangita Chandra told the court that the factory was situated in the Industrial area where no permission was required to run it and therefore no relocation was suggested to it. The MCD had, however, cancelled the industrial licence of the factory stating it was situated in a non conforming area. Arguing before a bench comprising Chief Justice A P Shah and Justice S Murlidharan, the DDA counsel said it was conveyed to the petitioner that the Nicolson Road was notified as a commercial street by the MCD and therefore no relocation was required for the industry. Earlier in 2004, the MCD cancelled the licence of the factory stating it was situated in the non performing area whereas the DDA stated the area was notified as commercial.
