Who filed the appeal

  • An appeal was filed by Sanjay Sharma against two reputed schools situated in Lucknow.
  • The schools did not disclose information as they are not aided by the State, thus, falling out of the purview of the RTI Act.

What was the decision

  • The SIC asked the Chief Secretary for issuing instructions to the private school for providing information sought by the appellant.
  • The parents and students heaved a sigh when the private schools in Uttar Pradesh were brought under the purview of the Right to Information Act and it was made mandatory for the schools to provide information sought under the Act.
  • The State Information Commissioner ordered for the appointment of Public Information Officers in private schools as well.

Court’s Observation

  • The Supreme Court had stated that if the school is given subsidized rates for the land, then the school would be deemed to be funded by the State.
  • It is mandatory for the District Education Officer to provide the sought information on demand.
