Supreme Court lawyer Ajay Agarwal filed arguments before the court of Chief Metropolitan Magistrate Kaveri Baweja praying not to close the sensational Bofors kickbacks case pending against Italian businessman Ottavio Quattrocchi.
The CBI had filed an application for closure of case against Quattrocchi stating that no material evidence has come up after two decades and the case be closed in the public interest.
Advocate Agarwal has filed an application before the court stating that the high-profile case against Quattrocchi should not be closed and he be treated as complainant in the case.
The CBI has opposed his appearance and status stating that a private person has no locus standi in the case and the closure application be accepted.
The Judge will pronounce her order on October 24.
Advocate Agarwal had submitted before the court that the present Solicitor General Gopal Subramanium and Additional Solicitor General P P Malhotra, who moved the application for closure, had represented one of the accused Win Chadha before different courts and they should have refused the brief on behalf of the CBI.
‘This attempt is nothing but a miscarriage of justice by the Central government itself and it will lead to promotion of government sponsored corruption,’ he added.
He also submitted that he has locus standi to be heard in the case as he is being heard before the apex court in the matter related to the accused in the Bofors case.
