The Supreme Court on Monday decided to hear in open court a matter related to the question whether there should be a judicial probe or a CBI investigation into the UP multi-crore provident fund scam that allegedly involves judges, including one from the apex court. A Bench headed by Chief Justice K G Balakrishnan in a chamber proceeding decided to hear the matter on Thursday. Earlier, Transparency International (India), also mentioned a petition in this regard and was allowed to be impleaded as a party in the matter. The petition filed through senior advocate Shanti Bhushan has opposed the idea of holding a probe into the scam by a retired or sitting judge of the apex court and instead sought a CBI investigation. Transparency International in its petition said a judicial probe would not only be completely against the Code of Criminal Procedure (CrPC) but would further strengthen the growing public perception that judiciary appears to be closing ranks to prevent any investigation into the scam. The court will hear its petition on 17th July along with the one filed by Adhivakta Kalyan Trust, Ghaziabad, and Bar Association of Ghaziabad. Senior advocate Fali S Nariman, appearing for lawyers' associations, on 7th July had described the scam as a "serious matter." He had said the scam in which names of 26 members of judiciary, including an apex court judge, seven Allahabad High Court judge, six retired High Court judge and 12 judges from subordinate judiciary in the state, have cropped up cannot be probed either by the police or the CBI.
