Live-In Relationships Not Prohibited; Such Persons Are Entitled To Equal Protection Of Laws: Punjab & Haryana HC

In stark contrast to this order, the High Court last week refused immunity to live-in couples who sought it in two different cases.

A week after two Punjab & Haryana High Court benches disapproved of live-in relationships, a third bench granted immunity to a couple who had entered into one (Pardeep Singh and Anr v. the State of Haryana).

Justice Sudhir Mittal opined in his order that an individual's right to life and liberty under the Indian Constitution requires the right to the full development of his or her ability in accordance with his or her choosing and that he or she is entitled to choose a partner of his or her choice for that reason

Bail cannot be claimed as a right: JJB Srinagar rejects bail plea of two juveniles in Krishna Dhaba terror attack

The Juvenile Justice Board (JJB) in Srinagar ruled that bail cannot be claimed as a matter of right in cases being prosecuted under the Juvenile Justice Act, 2015 (JJ Act) where there is a risk of the 'child in conflict with law' (CCL) being exposed to hardened offenders or repeating similar offences.

As a result, the JJB denied two CCLs' bail applications in the Krishna Dhaba terror attack case, in which militants shot a man working at the famous eatery Krishna Dhaba in Srinagar on February 17th of this year.

After the two CCLs were charged with murder and obstructing justice, a coram comprised of Principal Magistrate Touseef Ahmad Margey, members Khair-ul-Nisa and Dr Asima Hassan issued the warrant.

Rajasthan High Court Restrains Police From Arresting Accused Charged With Offences Carrying Upto 3 Yrs Jail Term Till July 17, 2021

The Rajasthan High Court on Monday (May 17) ordered the police to refrain from arresting the accused persons, who are charged with a crime carrying a maximum term of three years, until July 17, 2021.

Justice Pankaj Bhandari's bench ordered the DGP to give orders to all officers involved in the state of Rajasthan not to make arrests in cases where the accused is charged with an offence that carries a maximum penalty of three years and is tried by a First Class Magistrate.

"Section 97 CrPC Has Become Dead Letter": Supreme Court Urges Habeas Corpus Petitioner To Take Recourse To S. 97 In Matter Of Illegal Detention Of Wife By Father

The Supreme Court on Tuesday urged a petitioner who had filed a habeas corpus petition under Article 32 against his wife's father's unlawful detention to use section 97 of the Cr. P. C. (Search for persons wrongfully confined). "Because of these shortcuts, Section 97, Cr. P. C. has become a dead text," said Justice Dinesh Maheshwari.

It should be noted that section 97 of the Act provides that if any District Magistrate, Sub-divisional Magistrate, or Magistrate of the First Class has reason to believe that any person is confined in such circumstances that the confinement amounts to an offence, he may issue a search warrant, and the person to whom such warrant is directed may search for the person so confined; such search shall be conducted in accordance with the provisions of the Act.
