The delay in deciding the mercy Petition does not in any way warrant commuting the capital punishment . In fact there must be a time limit for deciding a mercy petition (say 6 months) . If no decision could be arrived by the President of India , the same should be referred back by him to the Home Ministry/Hon'ble Supreme Court stating his/her points leading to delay . In no case it should be politicised . | |

Any Administrative delay on the part of government machinery should not be a ground to commute death penalty into life sentence. Same is the case when the court decides a case after a period of long hearing or when an under trial prisoner waits for his turn for justice. In the case of death penalty court had already played its role. So my view is court should not interfere and decide the same case in any other manner. | |

Delay more than 1/2 yr must not be there in deciding mercy plea by the president and if Govt. fails to give its view,He should decide before fixed time of 1/2 years. | |
