Power to frame a Scheme.
9. Power to frame a Scheme. (1) The Central Government shall, for carrying into effect the purposes of this Act, frame by notification in the Official Gazette a Scheme as soon as may be after the commencement of this Act. (2) In particular and without prejudice to the generality of the provisions of sub-section (1), a Scheme may provide for all or any of the following matters, namely:-- (a) the registration of the claims under the Scheme and all matters connected with such registration; (b) the processing of the claims for securing their enforcement and matters connected therewith; (c) the maintenance of records and registers in respect of the claims; (d) the creation of a fund for meeting expenses in connection with the administration of the Scheme and of the provisions of this Act; (e) the amounts which the Central Government may, after due appropriation made by Parliament by law in that behalf, credit to the fund referred to in clause (d) and any other amounts which may be credited to such fund; (f) the utilisation, by way of disbursal (including apportionment) or otherwise, of any amounts received in satisfaction of the claims; (g) the officer (being a judicial officer of a rank not lower than that of a District Judge) who may make such disbursal or apportionment in the event of a dispute; (h) the maintenance and audit of accounts with respect to the amounts referred to in clauses (e) and (f); (i) the functions of the Commissioner and other officers and employees appointed under section 6. (3) Every Scheme framed under sub-section (1) shall be laid, as soon as may be after it is framed, before each House of Parliament, while it is in session, for a total period of thirty days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid, both Houses agree in making any modification in the Scheme or both Houses agree that the Scheme should not be framed, the Scheme shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that Scheme. 93
