Transfer of assets from India to executor or administrator in countryof domicile for distribution.
367. Transfer of assets from India to executor or administratorin country of domicile for distribution.-Where a person not having hisdomicile in 1*[India] has died leaving assets both in 1*[India] and inthe country in which he had his domicile at the time of his death, andthere has been a grant of probate or letters of administration in1*[India] with respect to the assets there and a grant ofadministration in the country of domicile---------------------------------------------------------------------1 Subs. by Act 3 of 1951, s. 3 and Sch., for "the States".165with respect to the assets in that country, the executor oradministrator, as the case may be, in 1*[India], after having givensuch notices as are mentioned in section 360, and after havingdischarged, at the expiration of the time therein named, such lawfulclaims as he knows of, may, instead of himself distributing anysurplus or residue of the deceased's property to persons residing outof 1*[India] who are entitled thereto, transfer, with the consent ofthe executor or administrator, as the case may be, in the country ofdomicile, the surplus or residue to him for distribution to thosepersons.
