ARMED FORCES (JAMMU AND KASHMIR) SPECIAL POWERS ACT, 1990

An Act to enable certain special powers to be conferred upon members of the armed forces in the disturbed areas in the State of Jammu and Kashmir Be it enacted by Parliament in the Forty-first year of the Republic of India as follows:—


SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT

(1) This Act may be called the Armed Forces (Jammu and Kashmir) Special Powers Act, 1990.

(2) It extends to the whole of the State of Jammu and Kashmir.


(3) It shall be deemed to have come into force on the 5th day of July, 1990. NOTES When the legislature fixes the date and clearly expresses the intention that the Act shall come into force from that date, it is immaterial whether the bill after having passed by both the Houses, receives the assent of the Governor or President, as the case may be, prior to such date or subsequently. In either case, the intention being express and manifest, the Act shall come into force on the date. Guntur Dist- Co-op. Mkg. Society Ltd. v. State of A.R, (1967) 20 STC 476 (AP).
