Cheque case

In 2018 we taken credit from my father friend by using land as security for 266000 and one blank Vijaya bank cheque as security and we repaid amount of rs 400000 through NEFT and he cancelled land agreement and transferred the land too, now he torchering my father to give 100000 pending interst is there like that and by using old Vijaya bank cheque he sent notice for Rs 400000 and we gave strong reply with NEFT evidence and in police station he said it's for 100000 in 2018 but we transferred amount in 2019

Cheque bounce for old invoice

Dear Experts,

In one of the case 1 cheque has been received in May 2024 for Invoice pertaining to year 2018. Now this has bounced , can we take legal action against this ? since invoice pertains to 2018.

Lease of property to son out of love and affection

I have commercial building in my sole name. Can I lease it to my son free out of love & affection so that he can sublet it and make income in his name and file his IT returns accordingly

Easement law

Sir,
My neighbour agricultural land owner and adjacent block my way to my Ag land by fancing, this way we are using from past 40-45 years,
Also in 1973
And now in 2024
Collector sir given this way documenty permission
Still he Kay installed fancing to block our way
He is considering only 3 foot path is sufficient to reach ag land , while vehicle for farming need more wide way.
Kindly suggest ur opinion please

seling joint proprty of 4 brothr in name of 1 deceased bro

There is one joint property of 3200 sq feet of four brother but on paper it is owned by only Elder brother. Now elder brother expired left with his only 1 son who is me. Now me & my 3 uncles want to sell property so what is best legal way i approach so in future i will not be in trouble and everything will be captured legally.

Can a sale agreement be considered as proof of payment?

a home buyer purchased a property from a builder. They executed a Sale Agreement which was registered. The sale agreement mentions the full consideration being paid by cheques. But actually it was paid by CASH. Can a sale agreement be considered as a proof of payment by NCLAT?

Insurance

Mr A was travelling in his own car and stopped on the road behind a Government Transport bus, which was picking up passengers. Meanwhile, a lorry which was driven in a rash and negligent manner came and dashed the car of Mr A from behind and the car suffered damages. Mr A called the police and the police reached the site and registered FIR against the driver of the crime lorry for rash and negligent driving. Mr A requested the insurance company with whom the crime lorry got third party insurance for getting the car repaired, but in vain. Mr A also got his car insured with some other insurance company, who told him to claim the damages from the insurance company of the crime lorry. The insurance company of the crime vehicle insist that Mr A claim damages from his own insurance company. Now the question arises whether the insurance company of the crime lorry neglect to pay the damages to Mr A and whether Mr A is legally entitled to proceed against the insurance company of the crime vehicle or is there any bar under Law to claim the damages of the car from from his insurance company with whom his car insurance letting of the insurance company of the crime vehicle. Any such provision of Law or precedent by way of court judgment that Mr A is required to get the damages from the insurance company of his own car rather than from that of the crime vehicle.

Succession rules pagari system for redevelopment

Dear Sir/Madam,

My late father owned a property in the Pagari system Mumbai, which is currently undergoing redevelopment. I am his elder son, one of the 4 legal heirs. The other heirs include the widow of my deceased brother, my step-brother who is currently staying in the property, and a married step-sister. Three of us moved to different places after marriage (myself, my late brother, and step-sister) and were not staying with my late father at the time of his demise.

Can the rent receipt be transferred to all legal heirs, which is currently in my father's name?
