My father who was an advocate passed away in april. So i applied after death benefit on insurance policy but local bar council willingly not issuing the cheque to me. What can i do for the same as they are saying I can get Benfit from U.P bar council only when local bar issue on their own level. I am feeling like frustrated. Please give the legal advice.

May the departed soul rest in peace.
Why the association / council is doing so?
When demised and when claim lodged?
Whether any communication received till date after submitting the claim?
Whether lockdown is reason for the delay?

Bar Association is right in its approach as the issue of the welfare fund and insurance of the lawyers is exclusively dealt with by the Bar Council of the particular State.

You should approach to the Bar Council of your State either directly or through the Bar Association Banda.

Yes, the Welfare Fund is managed by the Bar Council. The Bar Association is only facilitator.

Due to lockdown i was unable to claim as courts were closed so on 1st june i communicate with local Bar, According to joint Secretary of Bar who was my father's good friend 1 Lakh rs should get from local bar and 5 lakh from state bar of which the president and secretary also agreed, they told me to give an application i served the same but they are willingly not issuing the cheque of Rs1 lakh as my father was 40 year experienced senior advocate and his relation with secretary of bar was not good.

You should give sufficient time to the Bar to act upon your application and should not expect to get the imeediate results.

Such process take time in completion. Certain formalities has to be completed, please wait.

Lockdown has limited the speed / caplicity / volume of work.
