Parking problem in appartment

Dear Team,

Problem has errupted in the appartment on account some owners parking their car inside the appartment when the appartment owners are allowed to park only single two wheeler for each flat owners. But inspite of this some owners who have car in common have come together and bullying the rest of the other owners and not agreeing to park the cars outside the appartment.

Many times in the flat owners meeting it is been asked to the members who own the car to park outside the appartment but still then the car is parked inside the appartment.

Hence kindly guide as to what steps should the rest of the members take to put the cars outside? where should we give complaint? and what all necessary steps should be taken care before filling the complaint.

Filing a suit for injunction is only remedy now. You can complain with Registrar of Society but the result would be too far and few.

has cooperative society being formed? lodge complaint with MC . you can also raise issue in AGM . court should be last resort

co-operative society is not being formed. It is past 8 years that all the flat owners are residing at the appartment.

Move to court for injunction, consult local lawyer.

Call meeting of all flat owners. Take unanimous/majority decision to park cars outside the flat premises. All owners/supporting owners jointly meet and request the recalcitrant person to remove the car outside the premises. On non-compliance, send Regd+AD letter jointly signed by other flat owners, informing decision of the meeting and requesting to comply. If necessary approach a lawyer to proceed further.

If the unauthorized person do not comply with the decision of the society and do not remove his illegal possession thereto, initiate criminal as well as civil proceeding against him.
