Claiming compensation for alloted flat + Mental torture and threats by builder.

I must seek advice from experts to move forward and hope for right legal advice.

We are senior citizens tenant having been allocated a flat towards Permanent Alternate Accomodation as per Consent Terms filed in Bombay High Court in 2013.

The builder wanted us to surrender the flat for peanuts and go away but we didn't.

We Have suffered heavily at their hands financially besides severe mental torture and harassment in the past years and had to file two Contempt Petitions against them to protect our rights and in both the CP Court gave us protection and forced them to comply with the Consent Terms.

However they have changed the floor plan of the alloted flat besides reducing the actual carpet area without seeking consent from either from High Court or from us thereby forcing us to take further action as this is against the Consent Terms and the flat is of no use to us.

There has been attempt to murder my husband in the past to pressurize us to surrender the tenancy flat in the old building.

In above circumstances it's our compulsion to file another contempt petition in Bombay High Court for the sufferings undergone by us.

Our queries are hereunder:

1) We want to claim 1.5 Cr for the flat + 50 lacs for the harassment and mental torture. Is it possible?

2) This Contempt Petitions is followup from previous two Contempt Petitions due to deliberate repeated foul play by the builder. Can Compensation be claimed by filing the CP or if not what are our options.

3) Given our age 77+ and health issue we just can't risk our lives and take possession of the flat having several deviations as we are dealing with very resourceful white collered goons having police at their back and call.

We have been warned by police of dire consequences and no FIR was registered.

Since you have already dealt the matter through an advocate and as your advocate is knowing the complete history and background, any opinion rendered here without knowing the details of the cases, would be a misguidance and disastrous to your case.

You may better clarify all such practical issues through your own advocate.
