Advise needed on double regn of sale deed

We had purchased a plot in bangalore in 2005 for house construction and it is nearly complete. We are told now that the property was earlier sold to another person in 2000 who has now come to stake claim on it and filed a suit. Our vendor says it was an error in the plot no mentioned in the sale deed. Both the sale deeds were registered (surprisingly) by BBMP in 2001 and 2005 resp. 

 The vendor has agreed to give another plot in the same area which is agreeable to the first buyer. 

Question: What deed does the vendor enter with the first buyer to cancel the first deed. (Rectification deed on the first sale deed/cancellation deed/any other remedy)

What should we (as second buyer) do to ensure our rights are protected. 

How can we minimise the cost of the transactions through stamp duty etc. (All the parties)

you can once verify register office and issue public notice that we are ready to purchase here mentioned plot no, and address, so any one having rights immedialtly replie us.
