Amalgamation of two trusts

Respected Seniors,

There are two trusts with two different names under same trustees. One is fully under charity and other into education.  Is law allow these two trusts to amalgamate together and form a new trust with name some thing like 'XYZ Educational & Charitable Trust'.  This only for the convenience to avoid two filing of annual documents and maintaining accounts separately.

Your earnest reply is kindly solicited.

Best regards

Sasi Kumar G

Dear Mr.Kumar

The trust can be amalgamated by creating the new one which inter alia included the objectives of amalgamating trust. However you have keep in mind the following points :

1. the conditions stipulated in the trust deed

2. consent of Trustees of both the trust

3. proper dissolution of the trust

Important to mention that the law nowhere provides for the amalgamation of trust, therefore it is recommended that the trust deed should be drafted exhaustively.
