Atrocities on sc women by sc man

Dear Sudhiri A simple question of Law is to be answered "In case of atrocities upon a SC women (as serious as rape) by a SC man, thus the provision of The SC/ST (PREVENTION OF ATROCITIES) ACT get attracted?" YU dont need facts to answer this question of Law

ashok sc/st sct is enacted to to prevent the commission of offences of atrocities against the members of Scheduled Castes and Tribes, to provide for Special Courts for the trial of such offences and for the relief and rehabilitation of the victims of such offenses and for matters connected therewith or incidental thereto.

 

the statement of objective of the said act is :

 

“despite various measures to improve the socioeconomic conditions of SCs & STs, they remain vulnerable. They are denied a number of civil rights; they are subjected to various offences, indignities, humiliations and harassment. They have, in several brutal incidents, been deprived of their life and property. Serious atrocities are committed against them for various historical, social and economic reasons.”

 

now it is clear that objective of act is to relieve the sc/st from caste related harassment. the purpose of the offence must be to harass for caste. i don't know what is the  purpose of your offence ? is it caste related harassment ? if yes, then the act apply, if no, then it does not apply.

It is the choice and prerogative of a person giving free advise to know the facts.
