I have purchased a flat from private builder which is under construction. At the time of purchasing flat, builder has shown central green area, child play area etc. Now, when the flat is 90% complete, builder has come with new layout plan in which he has sold 50% of green area to schools and shops. When we complained to authorities, builder advocate appeared in hearing and showed plan which they got passed 3 years back with schools in central green area. Builder counsel justified that it is as per Govt. rules.
Now, my question to distinguished experts is that builder intentionally kept hypothetical layout plan in his brochures, advertisements showing maximum green area to influence people in buying flats. Whereas, he had already got approval from authorities on different layout.
Please advise if this matter is suitable for National Commission or Criminal Case or both.
