Car Parking

Dear All,


My query is related to the Parking space being sold by the builder at an exhorbitant price.


I bought a flat more than a year back but have not yet got its possession. At the time of the agreement, the builder verbally told us that the parking space would cost us around 3.5L. We were ready to pay him the amount then but he refused to accept it and asked us to pay at the time of possession. The Parking space is not added in the agreement.

We have the breakup of the price we shelled for the flat and the remaining amount to be given at the time of possession (including the parking space amount) mentioned on a paper which was agreed with the builder. But this is not signed by the builder.

Now the builder has increased the parking space cost 2-fold which is almost 7L and he is started selling the parking spaces on a first cum first serve basis.

He has asked us to buy the space at the earliest. I am not in a position to now pay the additional cost for the parking space.

My questions:

1) Is it not mandatory to have a parking space alloted to each and every flat? How can he sell them on a first cum first serve basis?

2) Can he sell the parking spaces at such high prices?

3) Can't anything be done in this case? Can I not get my parking space at the price agreed earlier at the time of agreement?

Would appreciate if you can help and advice me on the same.
