Car parking dispute. builder lies and supports them.

Our apartment has 16 flats+4 pent houses. We live in the 4th floor. This builder told us that there will be NO special parking space (neither for 2-wheeler or 4-wheeler) for pent house people ie. 4 familes who live in 5th floor (just above us). These 4 families belong to same caste (well most of the familes in our apartment) and I believe this builder too belong to the same caste. And they also help this builder in selling his flats in other apartments of his. Now the problem: A man from one of these families parks his bike in our parking space, and the builder supports him. He lies that we were told before selling the apartment that the parking space will be given to him but he didn't . He is simply lying to us.What should we do now? How can I proceed legally?

Another problem is that we don't have any documents regarding parking layout and infact documents of our apartment also. We have only the sale deed of our flat. All other documents were kept with one of the person in those 4 familes again (damn!). He is refusing to give the copies of those documents. I don't know what they've done with those documents. May be they have modified any documents according to their wish (I'm assuming). I need a solution please. They are ready to fight with us if we take a step forward.

File RTI Application to SPIO Corporation seeking certified copies of Approval plan and terms and conditions. You can just write a leter as format of application is not prescribed and paste Rs.10/- Adhesive Court fee stamp.  You can also send this letter by post with IPO fvg.SPIO,Municipal Corporation payable at Hyderabad.  There is citizen charter, and you can file application and get acknowledgment of application and can also pay fee in same counter and they will also give printed acknowledgment stating the date by which information will be provided to you.

Brief facts: Flat No...............Name.....................Location...........................(full postal address)

Information solicited:

1.Plese provide copy of blue print approval duly certified.

2)Please provide approval terms and conditions.d

Thank you for the reply. I would like to know what is SPIO Corp. and how can I file my complaint to RTI (online or offline)? Can you please provide your number over personal message? I'm little bit confused with the expalnation.

1.SPIO: State Public Information Officer, An officer designated to act as such in his capacity to provide information to citizens.

Corp: Hyderbad Municipal Corporation or that corporation that gives approvals for buildings and approves building plan/ maps/lay outs etc.,

There is a grievance segment in every Corporation's website and that can be search in Municipal Corporation website.

Take sale deed of flat , check all details systematically mostly you will get all if that deed is done properly including Building Plan no. Plot no. etc. Apply under RTI to various dept and get copy and maintain in box file for your record , you may require it in future while selling flat may be after 15-20 years

Sale deed doesn't have any details about parking layout. Also parking layout has no labels. I mean there are no flat numbers mentioned. It is just a plain document with parking areas and drive-way.

Parking space can not be sold to any one , no exclusive person can have parking space right , Regarding Parking Space If anyone have proper Judgement of Supreme Court or your state high court please provide him. This is confirmed 

I think this Co-oprerative society dispute , If Co-oprerative society is formed . Then may be as per your state act approch the court/officer who have powers to deal with co-operatiive society act and specific problem. If Co-opereative society is no forme then which other form of organiztion is formed , check that act and check the jurdisction

I mentioned in previous ans. to question that you don't have any document of the building and society etc. That was not related to Car Parking. But you should have all douments, like Sanctioned building Plan ,Occupying certificate , land record , society record etc. This should be your permanent record. And may be required some time during Court matter etc.
