Employer not paying my salary.

Dear Sir/Madam,

I was working in a software company. 1st August company terminate me without any reason and did not pay my salary. What will do against company and where I lodge complaint against employer?

Please suggest me about this matter?

1. YOU MAY KINDLY SEND A DETAILED LEGAL NOTICE TO THE SAID COMPANY MENTIONING FACTS AND FROM THE DATE OF YOUR APPOINTMENT TILL TERMINATION AND DEMAND THE ARREARS OF SALARY .ALSO MENTION IN SAID LETTER THE REMINDERS IF ANY SENT PREVIOUSLY.

2. THE COMPANY MAY SETTLE YOUR CLAIM.

3. BUT IF THEY DENY THEN YOU MAY FILE AN APPLICATTION BEFORE APPROPRIATE LABOUR COURT HAVING AREA JURISDICTION IF YOUR POST IS OF A WORKMEN . BUT IF YOUR DESIGNATION WAS OF OFFICER /MANAGEMENT CATEGORY THEN YOU MAY FILE A CIVIL SUIT/ WRIT PETITION BEFORE APPROPRIATE COURT   FOR RECOVERY OF SAME. GOOD LUCK.

Employer can not extarct work from even ;trainee, without wages.

I work in software company as a trainee. They terminated on 1 August without legal reason. They mention in letter" not follow the company policy" and not pay my remain salary. I have call many time. Can I submit this matter in labor court?

There are many IT/ITeS employee's unions and that have affilliated with trade unions.

Search and contact them for support.

'Software Trainee' might not be aprentice as per Apprenticeship Act.

Approach  avery able counsel specializing in Labor/service matters.

Your counsel may opine that you can approach/lodge complaint with:

 

Inspector appointed under; Delhi Shops & Estbs Act, Payment of Wages Act

O/o Labor Commissioner

Higher Officials of Dept. of Labor, Delhi

 

You may also lodge complaint with Inspector appointed under; Payment of Wages Act

 

Prefer to consult;  IT/ITeS employee's unions, Trade unions, A very able Labor law Consultant

hi, I have worked 7 month in company PREMIUM IT SOLUTION PVT LTD.They did not give me offer letter as per joining rule.now company terminated me without any prior notice.MY three month salary pending on company, tell me what should be the legal action against company.I have email proof and call recording proof that i have worked in this company and my salary pending.plz suggest me,
