False case 144/107.pls suggest.

We have some issue with our boundary wall to our neighbour, where they are claiming that wall was constructed by them before purchased of our land. But that wall is belongs to us which is clearly mentioned in our purchase deed and measurement of land also denotes that. Due to this boundary wall ownership and making other  small issues they are quarrelling since 2 years, but that was limited to our own.  Now suddenly they suit a case u/s 144/107 against our family. We are very much shocked when we came to know about the police case.

 

Other neighbours are also support to us as we are very much quiet   & peaceful resident. My father is a senior citizen and heart patient.

 

Now if you can make a way out for the next step from our side. Whether we can suit any case against them?

Hello There

Kindly write a letter to the senior police official stating the conduct of the police officer and get the bail in the said matter as a matter of right.

File a civil suit for the disputed part and then get the matter decided by the court.

The police has no jurisdiction to try the matter till the time it does not go violent and get the FIR quashed from the High Court U/s 482 Crpc
