Fd nominee other than legal heir

My father has a FD in bank in which his brother (my uncle) was declared as nominee. After his death, his brother (my uncle) is not willing to give the money of FD to my mother. What can we do now to get the money of FD from my uncle.

It is not necessary to approach your uncle for share, if FD amount still remains with the bank, approach the bank with legal heir certificate and raise your claim.

It is believed that you are Hindu.

If the bank has made the payment to nominee to uncle then Uncle has to make the payment to ClassI legal heirs i.e spouse, sons, daughters in equal share.

Ih he declines then it is fraud and you may lodge complaint with police,court.

If you father made FD prior to the marriage then you can claim that after the marriage you mother is the right person who can claim the money for her necessity. If you father made FD prior to the marriage then you can not claim because of you mother is there and your father declared his brother as nominee. Only nominee can withdraw money after due verification of all documents. And as per law only nominee can get.
