Sirs/Madams,
I have filed DV case before JMFC but for biased behaviour of the Magistrate I filed Transfer petition u/s. 408 of CR. P.C. and the proceedings in the said DV case have been stayed.
I came to know that the one of the Respondent in DV case, has committed offence of criminal breach of trust and hence I went to file complaint against him in JMFC then I came to know that it will go to the same JMFC .
Hence I want to know
is there any such provision in CR.P.C. that the new Complaint does not go before the same JMFC but goes before any other JMFC ?
