Invocation of bank guarantee by email

There is no bar to use email for invocation of bank guarantee by the beneficiary. Sec.10(d) of Information Technology Act 2000,provides for control, processes and procedures to ensure adequate integrity, security and confidentiality of electronic records. The party offering the electronic evidence must present sufficient evidence to support a finding that the exhibit in question is what the proponent claims it to be. The most common method of authentication is the use of testimony by a witness with knowledge that the exhibit is what it claims to be.
