Maintenance of flat

We have a flat in mumbai and taken possession in july 2015. As the society is not formed we are paying maintenance to the builder; from july 2015 to june 2016 (the amt was pd in advance) we pd the maintenance to builder at the rate of Rs 2 per sq ft. Since the society is not formed till date, the builder had increased the maintenance to Rs 3 per sq ft from July 2016 stating borewell water is salty so the entire water supply is through tanker water. Now the builder is asking to pay advance maintenance from July 2016 to June 2017.

1. my question is whether builder can raise the rate of maintenance as per his wish?

2. are we liable to pay advance maintenance for a year?

3. Can builder levy interest for not paying advance maintenance?  usually maintenance is due after completion of a particular month..

I think, you need not have to pay maintenance till you get allotment. You should check your agreement he might be hiddenly noted this. Better give payment by cheque or take clearly mentioned receipt so that you can take action in future. All members should appoint a lawyer is best way.
