Need info kul kayda

Sir, 

I have a farming land in Gujrat, in 7/12 my name is listed along with my uncle name. 

but my uncle does farming, i can say he does from last 4 decads.

he does not give us any thing by showing losses.

recently i came to know of kul kayada, so need more information.

this month I will be going to my village, but before that, if i can get more info, what should i do. will help a lot.

This kul kayda is local language in marathi 

Proper Act is - Maharashtra Agriculture and Tenancy Act 1949 (Old name of same act Bombay Agriculture and tenancy Act 1949) 

This is applicable when person outside family is doing cultivation like Tenants etc. If tenants are there after specific time in short original owner looses right (This in simple languate technically myself not going in detail) . So Since your uncle is doing this Act will not be applicable. He is family member . 

Since You are in Gujarat . I am not sure whether they have still retained above act or have drafted new act for agriculture tenancy . 

So long your uncle cultivates  no tension and don't keep tenant you don't need to worry  about this act.

For legal interest take following steps immedately 


1) Don't keep any tenant for agriculture land nor allow your uncle to keep any, if any just remove him immedately ,  it can be very fatal , agriculture tenancy law are very strict . 

2) Update all land records and see to it all your names etc are proper. 

3) Go to Land record deparment take all certified extracts of your land and maintain properly in your personal custody. 

4) Try to get measurement of Land done from Land Record department of State Govt. immedately and keep latest correct Measurement extract of land , it is very imp. as proof of dimension of your plot and area. You are not there if anythign happens you should be able to tell dimension with proof. 

5) Correct all land records if any mistake and once after this show to some local adv. whether till date all is proper . So no tension

6) Maintain atleast zerox of all local taxes etc about land with you .

I think this will safeguard your interst regarding your land. No need to worry about act which is not applicable to you. Follow 6 points and enjoy
