Notice period buy out option

Hi,

I am serving notice period, as I have another offer in my hand where i need to join in a month,

but my current company is refusing me to relieve they say that notice period policy has been updated to 2 months for all employees.

can anyone suggest me on how can i relieve early.

Did company provided / updated in email or document that, Notice period has been updated to 2 months ?

While you joininig whats the notice period duration ?

Has the company stated in writign?

Don't ask to relieve early.

Persist on separation by resignation on expiry of notice nperiod/LWD tendered by you. 

 

You have not posted full details and facts of employment.

What was recievd by you: offer letter or appointment letter?

Whats is the notice period inserted in it? Is it stated that T&C, service rules,HR pokicy as amended from time to time shall be applicable to you? Is it stated that service rules etc shall be placed at say; Employee's portal?

 

Is there any clause on notice pay in lieu of notice period in it?

 

Do you have copy of notice of resignation, proof of its disptach, proof of its delivery? Did you mention notice period/LWD in it?

 

Did you quote the clause numbers etc in it?

Has the HR or employer replied in writing to ask for serving 60 days notice period as per some revised policy?

Don't offer notice buy out option.

Let them supply you FnF statement showing payables by you and paybales by company and net payable.

Submit notice by letter addressed to good offices of appointing authority,MD thru Redg. Post.

Add by subsequent communication to whom you shuld handover the charge within and upto LWD!

Are you confirmed in writing or under probation period?

You are in which state?

What is this establishment; Commercial, Industrial?

Whats is its line of business?

What is our designation and nature of duties?

For how many months you are working?

Is your next employer willing to absorb you without any say relieving letter?
