Parent document

Dear Experts,

 

My mother bought a land in chennai outskirts on 1999. during this purchases, the seller of the property possess the saledeed (1999) of himself with his seller. However, his owner has lost all his original parent documents but possess only certified copy of the same till 1974. he issued a paper advt and executed an affidavit also.

My mother constructed a house in 2000 and till now (2018) it is under our possession. Once i heard that 13 years back document need not to be maintained.

kindly guide us.

Link documents are always necessary. Its better to keep them along with the records.

For any previous documents, you shall apply for the Certified copies of documents at SRO concerned or through E-seva.  Link documents are necessary for more purposes.

'Buyer Beware' applies to property deals.

It shall be appropriate to get proper legal opinion from a very able LOCAL senior counsel of unshakable repute and integrity specializing in revenue/property/civil/DRT matters and well versed with LOCAL applicable rules/laws and having successful track record…. and worth his/her salt , before signing or making payment.

This may cost some FEE but can defend long term interest and hard earned monies.

Obtain proper written legal opinion for NO defect in title and NO pendencies of any kind.

This applies in matter as posted by you also. Your counsel would have appraised you if original  docs were missing.

You may check to reconfirm, with O/o Authority under whose jurisdiction property falls e.g; MC, about what was heard by you.

And obtain authenticated copy of notification issued by authority.

Hearing, saying, said, told, heard etc are all verbal transactions and difficult to prove.

 

Otherwise one should maintain all original documents in chain of ownership, from 1st till last owner.

If original document is lost the correct procedure is to release newspaper advt, lodge FIR and obtain certified copies and keep copies of all. The certified copy thus issued by authority can serve the purpose.

You may obtain authenticated copies of mutation records with all link docs of old records from O/o Authority.The chain of ownership may show NO defect in title of your mother.

And update mutations in the name of your mother and obtain updated mutation records.
