Part of accused group staying abroad

When an FIR is lodged in Police Station against a group of family members implicating them for  deceiving the bride's  family  with suppression of facts and  under various sections of IPC for charges of abettment, conspiracy, cheating, besides 498A and sec.3&4 of Dowry Prohibition Act, if some of the accused family members are staying abroad, is the Police Station  in order to exclude them from the charge sheet, stating that they are abroad, and "how we can prove their knowledge of facts?" / their role in the crime.  Any case laws dealing such matters please?

Police may not file cargesheet against those accused whom they find innocent.
